Events were recorded April 29th, 2007 at Jacobson Park, Lexington, KY between 12 and 1 pm

I contacted my council person by phone and email in May of 2007 several times but received no response.

I met with an assistant county attorney in the fall of 2007 who recommended bringing the matter to the police.

I talked with a policeman by phone about the matter  early in 2008. The police officer recommended I contact my council person, as he could do nothing about the violation without their direction.

I emailed the councilmember in district 7 where the alleged violation occurred with no response.

On June 25th, 2008, I emailed my new district 11 council person, Peggy Henson, requesting her help in this matter. I am awaiting her response.

1) Notice how the same person applying for the permit is in charge of overseeing the event for Parks and Recs. "Rudy Cruse will be in charge for Parks."

* Note that on the list of Parks and Recs Staff, Rudy Cruse's" name is directly under Jerry Hancock (look for "Enterprise" column), the apparent Parks and Recs Superintendent signer of the permit
3) Notice how it clearly states the purpose of the event:  "Public Rally for Immigration Reform"
4) Notice the listed rules to be obeyed 1-12
     rule 4. No money or tickets can be exchanged or collected on premises.
     rule 9. Any groups who abuse the facility or violate rules and regulations will not be issued any future permits...
     rule 11. Applicant submits that this event is family oriented, non-commercial and that no sales will take place.
Food was sold, t-shirts were sold, memberships to KCIRR were sold.

Sec. 14-52. Same--Political speeches therein.

It shall be unlawful for any person to make a political speech or hold a political gathering or distribute political cards, placards, propaganda or literature, or to tack cards, posters or placards on the trees or buildings, in any public parks.

Any person violating this section shall be fined not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00) or shall be imprisoned for not less than ten (10) days nor more than thirty (30) days for each offense.

How many political, propaganda signs do you suppose were posted?

At least one political speech was made while I was present and more followed. Political placards were placed on buildings and all over the premises, political literature was given out. Yet the attorney for KCIRR said, "that's not a political event....we're not in violation of the ordinance...we're not promoting any particular law"
